Dentons filed an amicus brief with the Supreme Court of the United States today on behalf of its clients, DRI – The Voice of the Defense Bar & the Professional Services Council (PSC), in Campbell-Ewald Company v. Gomez, No 14-857. To be decided are issues of class-action mootness and derivative sovereign immunity. The legal issues in the case stem from an inadvertent and innocuous, one-time US Navy recruitment text message allegedly sent to Jose Gomez by Campbell-Ewald, a consulting firm engaged by the Navy to help develop a mobile marketing campaign.
Litigation partner Lisa Norrett Himes, Government Contracts chair Jessica Abrahams, Litigation co-chair Tami Lyn Azorsky, and Litigation partner Robin Conrad also contributed to the brief. The Dentons team has extensive experience defending government contractors subjected to private-party damages suits for helping the federal government carry out its work, both domestically and abroad.
PSC is the national trade association for the government services industry. Its membership is comprised of nearly 400 member companies of all sizes that provide the Department of Defense and other federal departments and agencies with professional and technology services.
DRI -The Voice of the Defense Bar is an organization of more than 22,000 attorneys involved in the defense of civil litigation. DRI is committed to enhancing the skills, effectiveness and professionalism of civil litigation defense attorneys, addressing substantive, procedural and policy issues germane to the defense of civil litigation, and improving the civil justice system.
